In a short sale, the servicer allows the borrower to list and sell the mortgaged property with the understanding that the net proceeds from the sale may be less than the total amount due on the first mortgage. Generally, if the borrower makes a good faith effort to sell the property but is not successful, a servicer may consider a DIL(deed-in-lieu of foreclosure). With a DIL, the borrower voluntarily transfers ownership of the property to the servicer - provided title is free and clear of mortgages, liens and encumbrances. With either the HAFA short sale or DIL, the servicer may not require a cash contribution or promissory note from the borrower and must forfeit the ability to pursue a deficiency judgment against the borrower. NEW FEDERAL GUIDELINES FOR SHORT SALES The Administration has adopted and This is how it will work: 1. PRE-SALE: The Bank will pre-approve the List price or give you an acceptable range for the minimum they require after the sales costs. They will also identify the sales costs (broker commissions and closing costs) that may be deducted from the final sales price. I will then list your property (like any home sale) at the approved price. 2. OFFER: When we receive an Offer, we will submit the required documents & get approved by the Bank if its in line with what was determined by the Bank. 3. Closing: Once the sale closes, The Bank will release you from all responsibilities for repaying your mortgage. Plus, you will receive $1,500 to help pay some of your moving expenses. In the unlikely event there is any additional money left over from the sale after paying the entire amount owed on the mortgage plus the approved sale costs, you will not be eligible to receive the $1,500.
